Important information:
Unless expressly agreed otherwise, all transactions between the MTB School Ortisei and its customers are subject to these General Terms and Conditions (GTC's). The object of the company is the operation of a bike school. In particular, this includes services such as teaching the skills and knowledge of biking, without guarantee of a specific training success, as well as guiding and accompanying during biking.

Registrations:
The payment of the service offer constitutes the contractual relationship. Both the services paid for on site and the online reservations are considered confirmed bookings. The MTB School Ortisei undertakes to comply with the offer sold, including the points listed below.

Data protection regulations:
The data necessary for the business transaction will be treated confidentially and will only be used for business purposes.

Content of the Online offers:
The MTB School Ortisei (hereinafter referred to as "author") assumes no liability for the topicality, correctness, completeness or quality of the information provided. Liability claims against the author relating to material or immaterial damage caused by the use or non-use of the information provided or by the use of incorrect or incomplete information are generally excluded, unless the author can be proven to have acted with intent or gross negligence.

All offers are subject to change and non-binding. The author expressly reserves the right to change, supplement or delete parts of the pages or the entire offer without prior notice or to discontinue publication in two parts or permanently.

Payment methods:
The offers can be paid by credit card, or when in the shop by cash or invoice.

If you choose the invoice with bank transfer, the amount has to be transfered to our bank account before the due date of the invoice. Possible expenses regarding the bank transfer must be taken over from the buyer.

Credit card payments in favor of the ski school are collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland ("TREKKSOFT"). TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your credit card statement. The domain where you enter and process your payment is owned and operated by TREKKSOFT.Please send an e-mail to support@payyo.ch for all inquiries regarding your credit card payments and chargebacks.
 

Cancellation:
The cancellation of a reservation must be made at least 48 hours in advance by email (info@mtbschool.it) or telephone (0039 0471 786242). Otherwise the full price will be charged according to the reservation.

Cancellation by the MTB School Ortisei:
The MTB School has the possibility not to carry out offers due to insufficient participants, weather conditions or similar. In these cases, the participants will be refunded the full amount paid. Further claims against the MTB School will be rejected. The MTB School may adapt or cancel the program due to critical weather conditions.

Rules of conduct:
The biker has to follow the advices of the bike guides. Each single rider is responsabile for their safety and practices this sport on his own risk. It is strongly recommended to wear appropriate bike clothing, including bike gloves and glasses. Helmet is obligatory. The MTB School Ortisei is not liable for accidents that occur before, during and after lessons. The conclusion of an accident or liability insurance is the responsibility of the participants.

Newsletter:
If you make a booking or purchase with us, send us an enquiry, request information or sales literature, we process your personal data in accordance with Article  6 Section 1 b and f.

If you would like to receive the newsletter offered on the website, we need an email address for you as well as information that allows us to verify that you are the owner of the email address given and consent to receive the newsletter (double opt-in).

You can withdraw consent at any time very easily through the unsubscribe function in the newsletter sent to you. The legal basis for the processing is point (a) of Article 6(1) GDPR. We use the data exclusively for sending newsletters.

Further data is not collected other than on an expressly voluntary basis, e.g. to optimise the contents to suit your interests. This data is stored by us and used exclusively to send the required information and to personalise the newsletter. In addition, we carry out link tracking to analyse and continually improve the newsletter content.

Our newsletters contain tracking pixels. A tracking pixel is a miniature graphic which is embedded in emails that are sent in HTML format to enable log file recording and log file analysis. In this way, statistical analyses can be produced and assessments of the success or failure of online marketing campaigns can be carried out. With the help of embedded tracking pixels, we can recognise whether and when an email was opened by you and which links you clicked on in the email.

We also use your child's date of birth to send direct marketing emails relating to bookings. We will always send the email via the parental email address which is proved in the booking process. You can object to this use at any time with effect for the future.

The personal data collected via the tracking pixels contained in the newsletters is stored and analysed by us, as the controller, to optimise the sending of the newsletter and to better adapt the contents of future newsletters to your interests. This personal data is not passed on to third parties. You are entitled at any time to withdraw the special declaration of consent regarding this via the double opt-out process. Once consent is withdrawn, we erase this personal data. If you unsubscribe from the newsletter, we interpret this automatically as a withdrawal of consent.

To produce the newsletter, we use the service “NumBirds” from Sports and Tourism Digital Services GmbH, 6020 Innsbruck, Brixner Straße 3/3. To safeguard the confidentiality of your personal data, we have come to an agreement with the company for processing.
